The customer is bound by the General Terms and Conditions valid at the moment of purchase (placing of the online order).
These General Terms and Conditions govern the operation of the online shop, the rights of the user, and the business relationship between the provider and the customer.

By confirming the order, the user is informed of the General Terms and Conditions, the protection of personal data, and the Legal Notice.

Prices

The prices of the products in the online shop are quoted in euro (€) inclusive of 22% value added tax, unless explicitly stated otherwise.

The prices are valid at the time of placing the order and have no predetermined validity.

The prices are valid in the case of payment by the payment methods indicated above and under the conditions indicated above. Despite our best efforts to ensure the most up-to-date and accurate information, it may happen that the information on the price is wrong. In such a case, or in the event that the price of the product changes during the processing of the order, the provider shall allow the customer to withdraw from the purchase, while at the same time offering the customer a mutually satisfactory solution.

The sales contract between the provider and the customer shall be deemed concluded at the moment the provider confirms the placed order. From this moment on, all prices and other terms and conditions are fixed and apply to both the provider and the customer.

Delivery

Our contractual partner for the delivery of shipments is Fully d.o.o.

Delivery for all purchases below the value of €99,9 shall be charged in accordance with selected shipping methods by custumer. The customer can choose between standard shipping- flat rate and express shipping via DHL post.

Standard shipping-flat rate costs € 3.50 for the area within Slovenia.

For other EU countries, the standard shipping costs € 7.50.

Express shipping via DHL post cost €16.00 for Slovenia and other EU countries.

Purchased products with a total value of €100 and above are shipped free of charge via standard shipping-flat rate within Slovenia and for the rest of the EU.

Delivery of products is possible within the EU.

In case of payment by PayPal or credit card, all orders placed on weekdays before 13.00 shall be dispatched within one to two working days. Orders marked for payment by pro forma invoice shall be dispatched upon receipt of payment to our bank account. Orders placed on weekends and holidays shall be dispatched the next working day. For products where a longer delivery time is indicated, this longer delivery time shall apply.

Fully d.o.o. is the contractual partner for delivery; however, the provider reserves the right to choose another delivery service if this enables the order to be fulfilled more efficiently.

Purchase

Select the product you wish to purchase and click on the ‘Add to Basket’ button. The quantity and total amount for the ordered products will be displayed at the top right of the basket. If you want to remove, reduce or increase the ordered quantity of a specific product, you can do so in the basket.

You can start the checkout process by clicking on the basket and the ‘Checkout’ button. The online shop will guide you through the following steps:
Step 1 – Enter your details,
Step 2 – if you have a voucher or promotional code from the provider, use it and indicate it in the relevant field below,
Step 3 – choose your payment method,
Step 4 – check your order; at this step you can check that all the information is correct,
Step 5 – order completed.

To execute the order, the customer must correctly fill in all the fields marked with a red asterisk (first name, last name, email address, address, city, postcode, and telephone number).
If the customer has a voucher or promotional code from the provider, they can use it and indicate it in the relevant field when placing the order.

After placing the order, you will receive a summary of the ordered products by email.
The purchase procedure for legal persons is exactly the same as for natural persons, except that you enter your company name and tax number at the end of the purchase. The payment methods are also the same.

The contract for the purchase of the ordered products between the customer and the provider is irrevocably concluded at this stage. By clicking on the ‘Submit Order’ button, you confirm that you have read the full terms and conditions of sale and payment set out herein and that these terms and conditions were expressly brought to your attention at the time of purchase.

The sales contract (order) is binding to the online shop and the customer. If the customer withdraws from the order/contract, they shall bear all direct costs incurred in the delivery as set out in the Consumer Protection Act (paragraph 6 of Article 43c). If the customer orders products from the online shop and subsequently refuses or does not accept delivery, they shall bear both delivery and return delivery costs. Delivery costs are determined by the delivery service.

The provider shall issue an invoice to the customer on a durable medium, itemised and sent to the customer by email.

Return of goods

Right of withdrawal, return of goods within 14 days.
In accordance with the Consumer Protection Act (the ZVPot), the customer has the right to return the purchased goods within 14 days without giving a reason. The customer shall notify the provider of the intended return no later than within 14 days of receipt of the goods via the contact form or by email at info@plant-immortelle.com , and return the goods within a further 14 days.

The goods must be returned in their original packaging, undamaged and unchanged, and the product must not show any visible signs of use. You must enclose the original invoice, the completed form you receive by email, and the details of your bank account to which you want to receive the refund. The address for the return of goods is Fully d.o.o., Trzaska cesta 40, 1000 Ljubljana, Slovenia. We recommend that you use a delivery service offering package tracking and to appropriately prepare the goods for transport (you can use the original packaging or another suitable and safe packaging). The costs of return delivery are borne by the customer. Please note that we do not accept cash on delivery packages.

The customer may claim a refund of the purchase price upon return, which the seller shall refund to the customer’ bank account no later than 14 days after receipt of the notice of withdrawal; however, the seller may withhold the refund until receipt of the returned goods or until the customer has provided proof that they have actually sent the goods.

100% satisfaction guarantee programme

We offer a 100% satisfaction guarantee on the first purchase. If the product does not suit the customer, they may return the product within 21 days and the provider shall refund the full purchase price of the product, less the delivery costs, in accordance with the terms and conditions of the 100% satisfaction guarantee programme set out below.
To claim the 100% satisfaction guarantee, please contact our company by email at info@plant-immortelle.com and describe in detail what happened when you used the product, how you used it, and why it does not suit you. Furthermore, please enclose your details: name, address, contact person, telephone number, and the number of your bank account for the refund of the purchase price. You must also enclose the invoice for the product. Our contact person will contact you and, upon receipt of the remaining contents of the product, which are to be sent to our address: Fully d.o.o., Podsvetija 22, 1351 Brezovica pri Ljubljani, you will be refunded the amount of your purchase, less the delivery costs and any promotional discount.
If the customer has purchased more than one identical product, the other identical products must be returned intact and undamaged in their original packaging. Only one identical product can be returned with the contents used.
We recommend that you use a delivery service offering package tracking or send the goods by registered mail and to appropriately prepare the goods for transport (you can use the original packaging or another suitable and safe packaging). The costs of return delivery are borne by the customer. Please note that we do not accept cash on delivery packages.

Payment method

The provider offers the following payment methods:
• Pro forma invoice (payment by pro forma invoice – payment to bank account). If you choose to pay by pro forma invoice, you will receive the payment details by email. Once the pro forma invoice has been paid in full, you will receive the goods you ordered. If the pro forma invoice is paid in part, the goods will remain the property of PLANT IMMORTELLE d.o.o. until further notice.

• Payment via Apple Pay
• Cash on delivery – valid only for the territory of Slovenia

Disclaimer

The provider makes every effort to ensure the currency and accuracy of the information published on its website. Nevertheless, product features, delivery times or price may change more rapidly than such changes can be made to the published information. In such a case, the provider shall notify the customer of the changes and allow them to withdraw from the order or replace the ordered item.

Even though the provider tries to provide accurate photographs of the products sold, all photographs should be taken as symbolic. The photographs do not guarantee the characteristics of the product.

Exclusion of liability

We reserve the right to disable the website or to prevent access to the website due to technical or other problems and maintenance, including disabling or preventing the use of the online shop. In the event of technical problems with the website, we reserve the right to cancel the placed orders that are affected by the technical problem. In the event of cancellation of orders, we will notify you as soon as possible and inform you of the next steps. It is your responsibility to ensure that you have adequate protection software (antivirus, etc.) before accessing and using the website, any passwords and usernames on the website.

Invoicing

Upon successful receipt of payment for the ordered products, we shall send the invoice for the ordered products in the form of a PDF document to the email address provided by the customer when placing the order on our website.
It is the customer’s responsibility to review all order details and specifications before proceeding with the order. Objections made at a later stage regarding the inaccuracy of the issued invoices shall not be taken into account.
In the case of cash on delivery, a PDF invoice shall be sent to the customer to the email address that they provided.

Liability for material defects

The seller shall be liable for material defects of the goods at the time when the risk of accidental destruction or damage passed to the customer. This usually occurs when the goods are taken over.
The seller shall also be liable for material defects which appear after the risk has passed to the customer, if they are the result of a cause which existed before that time. Insignificant material defects shall not be taken into consideration.
The provisions of Articles 37 to 40 of the Consumer Protection Act shall apply to rights and obligations arising from material defects.

Withdrawal from the contract by the provider

In the event of the customer’s breach of the provisions of the contract or these General Terms and Conditions, the provider shall have the right to withdraw from the contract without further notice to the customer. In such a case, the provider shall refund any amounts paid to the customer’s bank account.
The provider shall have the right to withdraw from the contract if the customer fails to fulfil their obligations, if the customer provides the provider with false information that makes it impossible or difficult to fulfil the contract, and if the customer fails to pay their obligations in accordance with the contract and these General Terms and Conditions.

Opinions, recommendations, reviews

Customer and user reviews, ratings and recommendations are an integral part of the website and are intended for the user community. By submitting an opinion, review or recommendation, the user expressly agrees to the terms of use of their opinion or comment and authorises the provider to publish part or all of the text in all electronic and other media of communication with the public. The provider shall have the right to use the content of the opinion or comment for an unlimited period of time and for any purposes that are in the provider’s business interest, including publication in advertisements or other marketing communication.
The provider allows any user of the online shop to write a review, which is reviewed by the provider before final publication. The provider shall not publish opinions or reviews that are in any way offensive or inappropriate or which the provider believes do not provide any benefits to other users and visitors.

Legal notice

The online shop is the property of PLANT IMMORTELLE d.o.o., which is also the administrator of the online shop. The content published in the online shop is the property of PLANT IMMORTELLE d.o.o. and may be used for non-commercial purposes, where it must, however, retain all the above copyright notices and may therefore not be copied, reproduced or otherwise disseminated without the permission of PLANT IMMORTELLE d.o.o. At times we cannot guarantee the complete accuracy and reliability of all published data. All warnings shall be taken seriously and the published information immediately corrected. We accept no liability for any consequences arising from the use of the information published in this online shop or from the temporary unavailability of the online shop. We reserve the right to make daily changes to the content, mistakes in prices and in the text. By using the online shop, the visitor, the customer, confirms that they accept and agree to the described terms and conditions.

Complaints and disputes

The provider complies with the applicable consumer protection legislation. The provider shall make every effort to comply with its obligation to establish an effective complaints handling system and to designate a person whom the customer may contact by telephone or email in the event of a problem.

The complaint procedure is confidential. The team shall acknowledge receipt of the complaint within five working days, let the customer know how long it shall take to process the complaint, and keep the customer informed throughout the process.

A provider, who as a provider of goods and services offers online commerce in the territory of the Republic of Slovenia, shall publish on its website an electronic link to the Online Dispute Resolution (ODR) platform.
